Joshua Ferraro: Punitive damages compelling reason not to text, drive
The Centers for Disease Control report that distracted driving is a contributing factor in more than 386,000 injuries and more than 3,000 deaths every year. To put that into perspective, you could fill Dolphins Stadium more than five times with the number of people injured from distracted driving every year. To put a finer point on it, in the last 10 years; this country has lost five times as many husbands and wives, sons and daughters to distracted driving than to the wars in Iraq and Afghanistan.
Unfortunately, despite the enormity of the loss created by distracted driving, so far the Florida legislative response has been fairly muted. On Oct. 1, the Florida Ban on Texting While Driving Law went into effect. It which prohibits use of wireless devices to communicate through emailing, texting or instant messaging while driving.
On its face, this legislation goes a long way toward combating the problem of distracted driving. However, the new law contains two broad loopholes that all but eliminate its ability to deter drivers from using their wireless devices.
First, because a violation under the law is designated as a secondary offense, law enforcement cannot stop a driver for texting unless another independent violation is observed. In a study conducted with regard to the deterrent effect of seat belt laws, the National Highway Traffic Safety Administration determined compliance is 11 percent lower where a secondary offense designation is given. Additional studies found primary offense designation coupled with adequate fines (Floridas texting fine is just $30)

LLL&S SUPPORTS WESTERN COMMUNITIES
The Thanksgiving holiday season found the Firm again supporting our western communities. Firm partner Mickey Smith, and his wife, Lizz, volunteered at the Wellington Boys and Girls Club’s annual Thanksgiving dinner. Mickey is on the Wellington Club’s Board. “Although we certainly enjoyed our own Thanksgiving, serving the kids was ten times more fun. They had a blast that night.” The Smiths also volunteered at the Central Palm Beach County Chamber of Commerce’s Salsa Fest, dubbed the “spiciest family festival in Palm Beach County.” The event features salsa dancing, salsa cooking, and salsa music. Mickey also sits on the Central Palm Beach County Chamber of Commerce’s Board and describes the event as having something for everyone in the whole family. “We know nothing about salsa dancing but they apparently thought we would do well at the beer truck. The irony is that we never even sampled the product – we were too busy.” The Firm has been strongly committed to volunteer work since its inception in 1927. “Lizz and I have lived in the western communities for over 20 years and Lizz has taught school here for that long as well. It’s our home. We like supporting organizations that make our home a special place to live. I am proud to be at a Firm that is so committed to giving back to the community,” Mickey said.

Lesser, Lesser, Landy & Smith supports Boys & Girls Club
December 7 saw (left to right) Mickey & Lizz Smith and Lee & Glenn Siegel come out to support The Boys & Girls Club at the annual Wellington gala. Glenn is a Board member of the Florence De George Boys & Girls Club in West Palm Beach, and Mickey is a Board member of the Neil S. Hirsch Family Boys & Girls Club of Wellington. Founded in 1971, the Boys & Girls Clubs of Palm Beach County is a not-for profit youth development organization dedicated to promoting the educational, vocational, health, leadership and character of boys and girls in a safe, nurturing environment. “Simply put, it is a fabulous organization that helps ensure that our youth do not fall between the cracks,” Mickey says. Glenn adds that statistics show “78% of our members would be taking care of themselves if not enrolled in the Boys & Girls Clubs.” In Palm Beach County, over 1,800 youth participate in club activities every day. The Firm is proud to support the Boys & Girls Club’s important work.

STUART – Like many grandfathers, Joseph Lesser was Gary Lesser’s idol. A superhero in a child’s eyes.
He remembers the elder Lesser dropping what he called “pearls of wisdom”, though Gary Lesser didn’t realize at the time just how important those sage nuggets would end up being.
One such pearl was his grandfather’s belief that volunteering and working in your community is not a service you provide, it is a debt you must repay.
“He told me everyone is born a debtor — to their family, their community, their church or synagogue and of course— their country,” Gary Lesser said. “We’re put on this Earth by the Creator to do good. We have a whole lifetime to pay off that debt, and a life of giving back is a lifetime well spent.”

Team LLL&S Hits The Links To Support Wellington Youth
October 12, 2013, saw team LLL&S active in two separate golf tournaments in the Wellington area. Mickey Smith (center in top photo), who serves on the board of the Wellington Boys & Girls Club, led a foursome at the Club’s annual golf tournament. At the same time, his wife, Lizz (far right in bottom photo), was at a different course participating in a fundraiser for a local youth hockey team. The ladies wore pink in honor of National Breast Cancer Awareness Month. "It was a great day for golf and it’s always a great day to raise money for the youth of our community," Mickey said. "My only regret is that the women’s team scored so much better than the men did. Lizz will never let us live it down."

Ma Ailun, a 23-year-old Chinese woman, picked up her iPhone 5 to answer a call while the battery was charging and was electrocuted last Thursday, according to a report from Chinese news outlet Xinhaunet. Apple is looking into the report.

On May 15th Chad was surprised by an entourage
from the Healthy Start Coalition of Martin County welcoming him to the 2013 cast of Dancing with the Martin Stars. Meeting Chad for the first time was Valorie Pari, Chad’s dance partner who is with Fred Astaire Dance Studio in Stuart. Valorie and Chad will be spending a great deal of time together in the upcoming months as Valorie takes on the challenge of teaching Chad to dance, and choreographing their routine. The third annual dancing event will take place on September 28th at the Lyric Theatre in Stuart, Florida.

On June 12th, 2013 FAU's Charles E. Schmidt College of Medicine Announced
their first University Sponsored Residency Program. Over 100 community leaders from partnering hospitals, FAU Board of Directors, FAU Foundation Board of Directors and several distinguished guests attended the reception. Dr. David J. Bjorkman, M.D., M.S.P.H., Dean and Executive Director of Medical Affairs, thanked the partner hospitals who were instrumental in planning and implementing this residency program. Remarks were also given by Dr. Mary Elizabeth Roth, M.D., Vice Dean for Graduate Medical Education and Clinical Affairs, as well as the acting President of FAU Dennis J. Crudele.
Gary S. Lesser, Managing Partner of Lesser, Lesser, Landy & Smith and a member of the FAU Foundation Board, commented that he was proud of FAU Medical School’s Internship Program. “FAU’s medical school is doing so well, and it’s great for our community as well,” noted Gary. “FAU continues to prepare the next generation of highly qualified physicians who because of this program, are now able to continue their career training in Palm Beach County.”

More than 1,000 people attended Whole Child Connection’s Family FunFest,
one of the area’s biggest children’s events, at the Lyric’s Flagler Center and Flagler Park in downtown Stuart. Lesser, Lesser, Landy & Smith PLLC sponsored the fourth annual event. The kids participated in a variety of activities, including gymnastics, pony rides, face painting, bounce houses, hands on arts and crafts projects and a gaming booth. They also observed karate and jazzercise demonstrations. Eight lucky community “stars” received surprise visits notifying them they were the contestants selected for the 2013 Dancing with the Martin Stars to benefit the Martin County Healthy Start Coalition. Building for Habitat for Humanity
South Palm Beach County Florida Association for Woman Lawyer's President Angelina Namia, LLL&S Attorney Merryl Silverman Haber, and Board Member Diana Hileman were eager to get out on Saturday and help build a home with Habitat for Humanity. Fifteen adult volunteers worked alongside Habitat homeowners and the construction crew to build an affordable house for a family in need. The firm is very happy Merryl is so involved with such a wonderful cause.

Boca Women Building Together
Boca Raton Chamber Leads Group women, friends and other volunteers helped Habitat for Humanity South Palm Beach raise $100,000 during the May Women Build 2012 Week. This Mother’s Day season, Attorney Merryl Haber and Paralegal Michele Groves of the Firm participated in a national Habitat for Humanity initiative uniting thousands of women in the “Build Generation” in creating affordable housing in partnership with low-income families across the United States. The volunteers hung drywall, painted, and installed roofing materials on the two bedroom home located in Boynton Beach.

Special Meeting at the Palm Beach County Bar Association
The Palm Beach County Bar Association hosted a meeting with some of its older members on Thursday, February 23rd. Most members were from the old Historical Committee, since disbanded. They so very much appreciated being invited for their traditional Russo’s lunch and they loved the new PBCBA building. What a great group. This was Lillian’s third consecutive year in competing, making it to the National twice.
