A 1927 Personal Injury Case

The State of Florida has experienced profound change during the past 92 years.  For example, in 1927, the population of the entire State was slightly less than Palm Beach County’s current population.  Gasoline was only 21 cents a gallon in 1927.

Personal injury law has also undergone drastic changes during this time. The Florida Supreme Court case of S. A. L. R. R. Co. v. Watson, 113 So. 716 (Fla. 1927), is archaic by modern standards.  The case, arising from an automobile accident, uses stilted language and discusses “contributory negligence.”  Under that concept, if an injured party is negligent to any degree – even 1% — a personal injury case cannot be maintained.  Thankfully, in the later case of Hoffman v. Jones, 280 So.2d 431 (Fla. 1973), the Florida Supreme Court rejected “contributory negligence” and instead adopted “comparative negligence.”

“Comparative negligence” is still the law in Florida today.  Simply put, the jury compares the negligence of the injured party to the others involved in the accident.  An injured party who is 60% at fault, for example, is not precluded from proceeding forward with a case.  Instead, the injured party’s recovery is diminished by his percentage of negligence, as determined by the jury.  In this example, the injured party’s gross recovery would be reduced by 60%.  The jury can apportion the total fault (i.e., 100%) however it deems appropriate.
