Let’s first talk about how it’s not determined. It’s not determined by who the police officer gave the ticket to. In Florida, the determination of the officer typically is never admissible in a lawsuit. The jury will determine fault based upon the facts they hear at the trial. And of course, if there’s a settlement before trial, it’s subject to negotiation between the lawyer and the insurance adjuster.
