Speaker 1: Nursing homes are liable under Chapter 400 of Florida statutes. That sets forth what the resident’s rights of each resident of a nursing home is. In situations where one resident hurts another, one would have to take a look at the specific circumstances. How was that resident allowed to hurt the fellow resident? Were they placed inappropriately? For instance some people with Alzheimer’s unfortunately have a propensity to violence. If the nursing home was aware or should have known of the one resident’s propensity to violence certainly they can be held accountable for the actions of that resident when they actually become violent.
