Prior to filing a lawsuit for nursing home abuse, the first step along the way is to obtain all the medical records. We obtain not just the chart from the nursing home where the loved one was injured at, but all of the related records in order to compare them to see if any of the injuries were pre-existing or if they were documented in the primary care physician’s chart or elsewhere.

Once we have all of those records and we determine that a valid claim exists, we enter the pre-suit period. We place a nursing home on notice of the claim by providing them with a statutory letter. We begin this discovery process where we exchange information and ultimately, at the end of the pre-suit period, if the claim is denied then we will file a lawsuit.
