What is the difference between a nursing home case and a medical malpractice case?

Under Florida law, nursing homes are governed by chapter 400 of Florida statutes. In order to be successful in a nursing home case, one would have to prove that the residents rights were violated. Alternatively, medical mal-practice is governed by chapter 766 of Florida statutes. In order to be successful in a medical mal-practice case, one has to prove a deviation from the standard of care, meaning that the physician or doctor at issue, took action, or inaction that is not reasonable in the eyes of a practitioner of a similar specialty.
